My HeadQuarters Terms and Conditions;

1. Introduction
1.1 These Terms and Conditions, as amended from time to time, and any rules published by myhq from time to time ('myhq Rules') govern all aspects of myhq.
1.2 In the event of any conflict between these Terms and Conditions and the myhq Rules, these Terms and Conditions shall prevail.
1.3 Your membership in myhq will be governed by these Terms and Conditions and the myhq Rules, and it is your responsibility to read and understand them. Further clarification can be obtained from myhq reception.
1.4 Each Member of myhq is responsible for remaining aware of the Terms and Conditions and the myhq Rules.
1.5 These Terms and Conditions are effective as at the date of publication (May 2009).
1.6 Every effort has been made to ensure the information provided in relation to myhq is correct. However, to the extent permitted by law, myhq accepts no responsibility for any inaccuracy or misdescription.
2. Definitions
2.1 In these Terms and Conditions, unless the context otherwise requires:
'Member' means any person or business who have taken up “MyClub” membership at myhq. Members receive special benefits as a result
'MyClub' means membership of MyClub which is a type of membership offered by myhq.
'Benefits' means any of the facilities, discounts, services or arrangements offered or available to the Member from time to time as a result of membership in myhq;
'Business Centre' means an area or section located within myhq dedicated to business purposes;
'myhq' means The Trustee for MYHQ trading as myhq ABN 98 368 363 576
'Myhq reception' means the centre established by myhq where membership information is processed and myhq is administered;
'Suppliers' means partners or suppliers who supply product or services to myhq
3. Types of membership
3.1 Individual membership is open to individuals who are over 18 years of age and is not transferable.
4. Changes to myhq Terms and Conditions
4.1 myhq reserves the right at all times to vary the MyClub Rules, myhq Terms and Conditions offered at any time.
4.2 myhq will use reasonable endeavours to advise Members of any such changes, but will not be liable in any way for any failure to do so.
4.3 Without limiting this clause 4 in any way, Members will be taken to have received notice of any changes to these Terms and Conditions if Myhq notifies the Member of the change by any method and/or by posting details of the changes on the myhq website www.myheadquarters.com.au
5. Membership
5.1 Should the member indicate to myhq within two (2) weeks of first payment of the membership that the member would like to withdraw from being a MyClub Member myhq will cancel the membership. Otherwise, membership is non-refundable.
5.2 Members must enrol separately and may only hold one membership of myhq.
5.3 Each Member shall be responsible for advising myhq in writing of any change of name as well as email and mobile number.
5.4 The membership is valid for use only by the Member and are not transferable in any circumstances.
5.6 myhq expressly reserves the right in its absolute discretion to withdraw, cancel, withhold, deny access to, or use of, or in any way change the membership fee or any of the benefits previously advertised or offered generally or to any member at any time, and myhq will not be liable for any loss or damage suffered by the member resulting from such withdrawal, cancellation, variation or change.
6. myhq Services
6.1 Some of the Benefits which are offered to the Member are provided by suppliers over which myhq has no control. Arrangements for the availability and utilisation of the Benefits  offered are made by myhq solely as agents for the suppliers providing such Benefits. The provision of the Benefits will be subject, in each case, to the terms and conditions of the suppliers providing such Benefits and any claims relating to the supply of Benefits should be made to the supplier.
6.2 myhq will not be liable for refusal of any supplier of myhq Benefits nor will myhq be liable for any loss or damage whatsoever, whether in whole or part, of any Benefits.
6.3 Access to the Business Centre or the Internet may be available in myhq lounge at a surcharge. myhq is not liable for any third party content on the Internet that the Member may find offensive, upsetting or defamatory. The Member is responsible for maintaining the security of all log-in identification information made available to them to access the Business Centre systems or the internet in the lounge. To the extent permitted by law: myhq is not liable for any personal security breaches suffered by the Member or their guests when using Business Centre equipment or the internet access facility in myhq lounge, and myhq is not liable for any loss or damage suffered as a result of the unavailability of the Business Centre equipment or the Internet, including interruptions during use. myhq does not represent or warrant that the Business Centre equipment or Internet access is free from computer viruses or other defects.
6.4 The user assumes all responsibility for all loss, damage or consequences resulting directly or indirectly from use of the Business Centre equipment and the Internet. To the extent permitted by law, myhq is not liable for any loss or damage suffered in respect of use of the Business Centre equipment or the Internet in the lounge.
7. Termination
7.1 myhq expressly reserves the right to terminate or alter (materially or otherwise) any Benefits, or any aspect of the operation, of myhq at any time, without notice.
7.2 The Member can terminate membership in writing given 30 days written notice.
7.3 Any breach of these Terms and Conditions whether intentional or otherwise may result in termination of membership, cancellation of Benefits, or both, at the sole discretion of myhq.
7.4 Myhq may terminate a membership if, in the reasonable opinion of myhq, the Member has:
    * Abused any facilities, services or arrangements accorded to the Member as a result of membership in myhq;
    * Acted in any way which is likely to be detrimental to the interests of myhq or any Partners;
    * Supplied or attempt to supply misleading information, or make any misrepresentation to myhq or any Partners.
8. Access to facilities
8.1 Access to business lounge and business service is charged based on usage.
8.2 Myhq staff have the discretion to refuse entry to any Member or guest at any time for any reason deemed appropriate by myhq.
8.3 Smart, casual dress standards apply at all times. myhq staff will have discretion to alter these standards if circumstances warrant.
9  Payments of membership fees and services
9.1 Membership fees will be charged monthly either on 1st or 15th of the month.
9.2 Additional services and fees on account will be settled every 2 weeks
9.3 Late fees may incur a late payment fee of $25
9.4 Payment via creditcard will incur a 2% surcharge for Mastercard/Visa card and a 3% surcharge for payments via Amex
10. Governing laws
10.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Western Australia and any action or other legal process with respect to any matter or thing in connection with these Terms and Conditions against myhq shall unless otherwise agreed by myhq be instituted and carried on only in the appropriate Court of the State of Western Australia.
